Failure to Protect

Prison and jail officials have a responsibility under the Constitution to protect incarcerated individuals in their care. But far too often, prison and jail staff turn a blind eye to abuse by other incarcerated individuals and other employees at the facility.

Recent Representative Cases

Settlement

Represented family of a man whose beating was witnessed by scores of guards, all of whom did nothing to help the man, who later died of suffocation; case settled favorably after depositions of key witnesses.

Jury Trial Win

Represented incarcerated man who was beaten while other guards watched on without intervening or stopping his abusers, and whose requests for medical care for his injuries were ignored; won verdict at trial including substantial punitive damages.

Failure to Protect

Represented classes of individuals in lawsuit alleging inadequate protective measures related to the Covid-19 pandemic, which quickly spread throughout correctional facilities.

Failure to Protect

Representing a woman who was sexually assaulted by her cellmate against the department of corrections officials who failed to protect her despite repeated pleas for help, where the victim had no history of incarceration but was housed with a woman with a long record of violent offenses.
